Building Dispute, Bulged Swimming Pool, Cost to Fix?

My clients have had their fibreglass swimming pool develop a bulge in the side and bottom. Builder attempted unsatisfactory repairs. This is what I said:

Summary of the Report Findings:

The swimming pool has structural movement and has bulged. The probable cause of the bulge is hydrostatic pressure from surrounding soil that has become unstable because of a heating pipe leak (since repaired).

The builder has attempted to repair the bulge in the pool by cutting out a section of the pool bottom and applying a patch over. The attempted repairs are considered unsuitable and unsatisfactory and the pool shell should be replaced.

The swimming pool builder is required to replace the pool shell and in the event of refusal, the owner has the option to lodge a VCAT claim for damages and compensation to have the works carried out by others.

The matter did go to VCAT but as the builder became insolvent owners pursued the claim with the builders insurer. In addition to the expert report I was engaged to prepare the costs of : pool demolition, shell replacement and reinstatement. Example below:

As a trained quantity surveyor and very experienced estimator I was able to produce estimate that prevailed and the owners negotiated a good result.
